Overview
Aroha (“Aroha,” “we,” “us,” “our”) provides an online platform for mental health practitioners, clinics, and their clients in India to manage appointments, session notes, secure messaging, video consultations, documentation, and compliance tasks. By signing up for, accessing, or using any part of the Platform, you agree to be bound by these Terms & Conditions.
Eligibility
- Practitioners and clinics must be duly qualified, licensed, and compliant with all professional and legal regulations for mental health services in India.
Account Registration & Security
- You agree to provide accurate, complete, and updated information during registration and to keep this information current.
- You are responsible for safeguarding your account credentials and for all activity on your account.
- Notify Aroha immediately of any unauthorized use or security breach.
Platform Usage
- Use Aroha only for lawful purposes related to mental health practice or accessing care.
- Do not misuse the Platform (including trying to access it by unauthorized means, uploading viruses, or interfering with security features).
- You may not resell, sublicense, or lease access to the Platform without written permission.
Practitioner-Client Relationship
- Aroha is a technology platform and does not provide medical or clinical services itself.
- Practitioners are solely responsible for the quality, safety, and appropriateness of care provided to clients.
- Information exchanged via the Platform does not constitute medical advice from Aroha.
Privacy & Data Security
- Aroha respects your privacy and processes all information in accordance with its [Privacy Policy].
- Sensitive client data, session notes, and communication are encrypted and stored securely.
- Users may be subject to data storage, retention, and privacy rules under Indian law (including the DPDP Act).
- You agree not to share confidential client information except as permitted by law and professional guidelines.
Payment & Subscription
- Practitioners and clinics may need to purchase a subscription plan to access premium Platform features. Plans, pricing, and payment methods are detailed within the Platform.
- All fees are inclusive of applicable taxes (e.g., GST) unless clearly stated.
- Late or failed payments may result in suspension or termination of Platform access.
Intellectual Property
- All Platform content, software, branding, and intellectual property are owned by Aroha and/or its licensors.
- Users may not copy, modify, distribute, or reverse engineer the software without prior written consent.
Third-Party Services
- The Platform may integrate, reference, or link to third-party services (e.g., Google Calendar, WhatsApp, Video APIs).
- Aroha is not responsible for the content, terms, or privacy practices of those services.
Limitation of Liability
- Aroha is not liable for any indirect, incidental, or consequential damages arising from Platform use.
- Platform is provided “as-is” and “as-available”; Aroha does not guarantee uninterrupted or error-free operation.
- Aroha’s cumulative liability to you for any claim or loss may not exceed the amount paid to Aroha in the past 6 months.
Termination
- Users may request to suspend or delete accounts at any time; Aroha may terminate access for breach of Terms, unlawful use, or at its sole discretion.
- Upon termination, you must stop using all Platform features and delete any confidential or proprietary data obtained from the Platform.
Modifications
- Aroha may update these Terms from time to time. Notice will be provided within the Platform and/or via email.
- Continued use after the updated Terms take effect constitutes agreement to the changes.
Dispute Resolution & Governing Law
- These Terms are governed by laws of the Republic of India.
- In case of any dispute, the courts shall have exclusive jurisdiction.
